Horizon Tire Inc. filed two lawsuits in California against Shandong Linglong Tire Co. Ltd. and two of its subsidiaries, Linglong Americas Inc. and LLIT (Thailand) Co. Ltd., earlier this year. Linglong subsequently filed a suit of its own in Ohio against Horizon Tire.
In its first lawsuit, filed in May, Horizon alleges fraud and civil conspiracy, breach of contract and “Money Had and Received” against the corporate defendants and two individual defendants -- including CEO Feng Wang -- over a loan defendants borrowed from Horizon.
In a separate lawsuit filed in June, Horizon alleges fraud, “Intentional Interference with Contract as well as Intentional Interference with Prospective Business Advantage among others” against the same corporate defendants and Wang.
In its suit, also filed in June, Linglong claims breach of contract for the non-payment of goods ordered and received by Horizon, “some of which were wrongfully rejected.”
Also at the core of Linglong’s suit is whether or not Horizon, a California-based tire distributor, had any exclusive rights to sell tires produced by Linglong.
