Vaccine Mandate Faces 'Uphill Battle"

The Biden White House’s large employer vaccine mandate is facing “an uphill battle,” according to the Tire Industry Association (TIA.)

The United States Circuit Court of Appeals for the Fifth Circuit has issued a nationwide stay blocking the mandate, which requires privately held companies with more than 100 employees to make sure their workers receive COVID-19 vaccines.

The court has ordered the Occupational Safety and Health Administration (OSHA) to not implement the order.

TIA officials say that challenges to the mandate “have been filed in multiple federal circuit courts across the country” and “when there are multiple filings like these, a multi-circuit ‘lottery system is utilized for purposes of consolidation and clarity. 

“That lottery has chosen the Sixth Circuit, which is generally viewed as a favorable draw for OSHA vaccine mandate's challengers. We will provide updates as the Sixth Circuit issues any relevant orders.”
